As more couples live together without being married or in a civil partnership, the need for the law to change to match society’s social trends has grown. In law, if you are not married your rights regarding finances, children and property can be limited. A cohabitation agreement is a legal document that outlines the rights and responsibilities of each partner to one another.
A cohabitation agreement provides protection by formalising the financial obligations, property rights and other aspects of their day to day life, that could otherwise lead to conflict. Providing certain conditions are fulfilled, the courts are reluctant to interfere with a cohabitation agreement that has been entered into with independent advice and financial disclosure.
Pre-nuptial agreements are agreements entered into before marriage. They provide for the division of assets if a marriage comes to an end. In England and Wales, pre-nuptial agreements are not legally binding, but the courts are increasingly reluctant to interfere with the terms of a pre-nuptial agreement if both parties have entered into the agreement of their own accord and have had independent advice and financial disclosure. The courts will look at whether the terms of the agreement are fair and reasonable.
