Change in Circumstances

WHAT WE DO

Sometimes circumstances change, but you have a settlement, what can you do about it?

If your circumstances have changed materially since an Order or a financial settlement was made it may be possible to review that Order or settlement.

Income payments can always be varied whilst they remain payable, following a permanent and material change in circumstances, but capital payments and obligations can only be reviewed in very limited and exceptional circumstances.  If you believe there has been a material change in your circumstances you must obtain advice as soon as possible since any ongoing delay can prejudice the ability to review that settlement or Order.

We regularly advise clients on whether an Order may be capable of variation or of being set aside and regularly advise clients on whether agreements they have reached can be fully enforced in the absence of a Court Order.
