Cohabitation agreement

As more couples live together without being married or in a civil partnership, the need for the law to change to match society’s social trends has grown. In law, if you are not married your rights regarding finances, children and property can be limited. A cohabitation agreement is a legal document that outlines the rights and responsibilities of each partner to one another. A cohabitation agreement provides protection by formalising the financial obligations, property rights and other aspects of their day to day life, that could otherwise lead to conflict. Providing certain conditions are fulfilled, the courts are reluctant to interfere with a cohabitation agreement that has been entered into with independent advice and financial disclosure.

Prenuptial agreement

Pre-nuptial agreements are agreements entered into before marriage. They provide for the division of assets if a marriage comes to an end. In England and Wales, pre-nuptial agreements are not legally binding, but the courts are increasingly reluctant to interfere with the terms of a pre-nuptial agreement if both parties have entered into the agreement of their own accord and have had independent advice and financial disclosure. The courts will look at whether the terms of the agreement are fair and reasonable.

Post nuptial agreement

Like Pre-Nuptial Agreements but entered into after the marriage ceremony, Post-Nuptial Agreements can provide for the division of assets if a marriage comes to an end. Provided certain conditions are fulfilled, the Court will be reluctant to interfere with the terms of Post-Nuptial Agreements that have been concluded between parties freely and willingly with the benefit of independent advice and financial disclosure. We have significant expertise in advising our clients on what form a Post-Nuptial Agreement should take and how to maximise the chances of the document being enforceable in the unlikely event of a marriage breakdown at some point in the future.

Declaration of trust and property ownership

Declarations of trust outline the shares of ownership in a property. They are legally binding and set out the  financial contributions made to a property and what the ownership percentages will be. They protect  financial interests and can prevent future disagreements.  It provides important protection for cohabiting couples, if you are entering into a property arrangement for business or with family members. We provide full advice on property ownership disputes, and how declarations of trust will be treated by the court.
