Children Matters

We regularly deal with legal disputes and family issues concerning children. Child focused legal solutions promoting the best interests of the child are crucial to the welfare and dignity of the child.

Disputes over children

The child’s welfare is paramount and the court will always act in a child’s best interests. This is a very specialist area, that we have a lot of experience in, but as important as the knowledge in this area, is the approach of your lawyer which must be child focused. We represent our clients in all areas of dispute involving children and what process would be most appropriate in resolving the dispute.

Day to day arrangements or specific issues

If you have parental responsibility for a child, which is defined as all the legal rights, duties, powers, responsibilities, and authority a parent has regarding their child, you have obligations to make sure their needs are met and make decisions on their behalf. When more than one person has parental responsibility for a child, there are certain decisions that both parents must consent to (e.g schooling, changing a child’s name, where a child will live etc), certain decisions where one parent must notify  the other party with parental responsibility and decisions which involve the day to day arrangements for a child where there is no obligation for the other parent to consent to the decision or be notified. This is an area which causes a lot of conflict, early advice is essential and we can help draft a parenting plan or apply for a child arrangements order. 

Financial responsibility for your children (when married and unmarried)

If you have a child, you have a legal responsibility to provide financial support for them, whether you are married or unmarried.  These obligations can be dealt with by the child maintenance service.  Unmarried parties can also seek relief using Schedule 1 of the Children Act 1989 which, subject to certain circumstances, can allow a claim for maintenance, property transfers for housing, lump sums for specific expenses. The key is that any application is for the benefit of a child and the court will decide applications based on needs and the financial resources available. This is a very specialist area and requires careful consideration and legal advice. 

Relocation

In our increasingly globalised and connected world, families are often required to relocate either as a result of one parent being posted abroad or as a result of one parent wishing to build a life in a different country.  The relocation of children can only take place with the consent of both their parents or in accordance with an order of the court.  We regularly advise clients seeking to relocate with their children as well as clients seeking to prevent their children from relocating with their spouse or partner.  It is important that you obtain advice from us as soon as possible if you wish to relocate or if you believe your partner or spouse is seeking to do so with your children.
